KRMC Settles Car Accident Claim for $1,770,000.00
KRMC recently achieved a significant settlement for one its personal injury clients.
On a rainy night, Mr. D’s Honda Civic was struck by a tractor trailer making an improper left turn. Mr. D’s vehicle was crushed and he had to be extricated from the car. He suffered serious injuries including a major head injury that left him permanently impaired. KRMC’s personal injury department not only dealt with complicated insurance and legal issues, we also stayed by the family to help them through this difficult time and made sure that Mr. D. was receiving all the physical and financial assistance he was legally entitled to.
We are pleased to report that the case has now settled. In addition to hundreds of thousands of dollars of treatment received through statutory accident benefits, Mr. D. received a final settlement of both the accident benefit and tort portions of his claim in the amount of $1,770,000.00. KRMC arranged for a structured settlement that will ensure that Mr. D. and his family have their financial needs taken care of now and in the future.
M. was injured in a motorcycling accident in South Dakota and suffered catastrophic injuries. KRMC settled the accident benefits claim for over $1.1 million, here in Ontario.
D.M., a young man hurt his back outside a fast food chin restaurant when he slipped and fell on ice. KRMC settled his case for $100,000.
I., is an elderly gentleman who broke his leg in a parking lot accident when he was pushing carts. KRMC settled his case of $145,000.
Three ladies suffered serious injuries in a car vs. moose collision on the highway between Timmins and Ontario. No lawyer who they approached was willing to take on their case. KRMC settled their case for $350,000 on top of obtaining accident benefits for each of them.
Two clients were both in their 60’s when they fell. One fell on ice and one on a privately owned sidewalk. The first gentleman was semi-retired when the incident occurred. He fell on the ice in a friend’s driveway. He broke both his right tibia and fibula, and suffered extensive fracture blistering on his right leg that prevented immediate surgery. Eventually he had a titanium plate and eight screws surgically inserted to repair the injury. Unfortunately, he suffered from a serious infection of the wound and has been left with a large scar and a limp. He settled for $271,000 before discovery.
The second gentleman tripped over a broken entry step. He suffered a complete tear of the left quadriceps tendon and a torn bursa in his left knee. He was left with both pain and weakness in the left leg. The client had been a fine carpenter for most of his working life and could no longer climb ladders – he could barely climb stairs. Defence argued that payments for loss of future income should cease at age 65, and KRMC successfully argued for payment to age 70. The case settled for $245,000.00.
A young man fell down the ice and snow covered stairs outside his apartment building. He suffered a left elbow tear and fracture, with muscle damage and some nerve compression. He underwent surgery with internal fixation. Although there was some contributory negligence, this claim settled for $100,000.00 before discovery.
A client slipped and fell on a patch of ice on his way to work. He had a slight misalignment of his spine but had no symptoms before the fall. As a result of the fall, he experienced almost continuous pain and could only sit or stand for no longer than a 30 minute period. The insurer argued that he was employable and therefore should only receive a settlement for general damages. KRMC successfully argued that although technically “employable”, he would never be hired. The client accepted a settlement of $526,000.00 for both general damages and future loss of income and competitive advantage.
Mr. D. had a bull on his farm property that he wanted to remove. He instructed his farm manager to contact our client, Mr. P, and Mr. P agreed to attend the farm to help them remove the bull . While Mr. P was in the pen area helping the farm manager, the bull attacked our client and gored him and threw him up 20 feet in the air. Mr. P suffered severe stomach injuries and sustained major scarring on his stomach . Although other law firms would not take this case on due to the obvious liability difficulties, KRMC took the case and settled at the Pre Trial for $ 400,000.00.
